Australian Law Question?
Okay so I'm trying to figure out if I can prove recklessness or intention in this murder case. The accused pushed the victim on concrete (that's all it says), and he thought the victim was dead so he dragged to body by the neck to hide him. The man ended up living for a little but died because of the damage caused to his arteries in his neck from being dragged, Now, it's never said that he intended to kill... Are there any points where I could say that he foresaw death or serious bodily harm? Or would this be a case where I cannot support this as murder? THANKS!!!
